Privacy Policy

How Sui Sui Foods Pty Ltd collects, holds, uses and discloses personal information, and what you can do about it.

1. Our commitment

Sui Sui Foods Pty Ltd (“we”, “us”, “our”) is an Australian registered company based in Victoria. We handle personal information in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs) contained in Schedule 1 of that Act.

This policy explains what personal information we collect, why we collect it, how we hold it, who we may disclose it to, and how you can access it, correct it or complain about how we have handled it.

2. What personal information we collect

We are a business-to-business food wholesaler, so most of the information we hold relates to people acting in a business capacity. The personal information we may collect includes:

  • Identity and contact details — your name, business or trading name, position, email address, postal and delivery addresses, and any telephone number you choose to give us.
  • Trading information — the products you order, order history, delivery instructions, pricing agreed with you, purchase orders and invoices.
  • Account and credit information — information you provide on a credit application, including business details, trade references and payment history with us.
  • Correspondence — the content of emails and enquiry forms you send us, and our replies.
  • Technical information — limited information generated when you visit our website, described in section 7 below.

We do not seek sensitive information as defined in the Privacy Act, and we ask that you do not send it to us. If you provide sensitive information unsolicited, we will deal with it in accordance with APP 4.

3. How we collect it

We collect personal information directly from you wherever it is reasonable and practicable to do so — when you email us, complete the enquiry form on this website, apply for a trade account, place an order, or take a delivery from us.

We may also collect information from third parties, such as trade referees you nominate on a credit application, or publicly available sources such as the Australian Business Register. Where we collect your information from someone other than you, we will take reasonable steps to tell you, as required by APP 5.

You may deal with us anonymously or under a pseudonym when making a general enquiry. However, we cannot open a trade account, supply goods, deliver an order or issue a tax invoice without knowing who you are.

4. Why we collect, hold, use and disclose it

We collect and use personal information for the following purposes:

  • to respond to your enquiry and provide a price list or quotation;
  • to assess an application for a trade account and manage credit risk;
  • to process, pick, deliver and invoice your orders;
  • to keep records of batch and consignment information so that a product can be traced and, if necessary, withdrawn;
  • to manage our trading relationship, including account queries, returns and credits;
  • to comply with our obligations under Australian law, including taxation, food safety and record-keeping requirements; and
  • to send you information about products, availability or pricing relevant to your business, where you have asked for it or would reasonably expect it.

We do not use or disclose personal information for a secondary purpose unless you would reasonably expect it and it is related to the primary purpose, you have consented, or the use or disclosure is required or authorised by law.

5. Direct marketing

If we send you commercial electronic messages about our products, we will comply with the Privacy Act and the Spam Act 2003 (Cth). Every such message will identify us and include a simple way to opt out. You can also ask us to stop at any time by emailing [email protected], and we will action the request without charge.

6. Who we disclose information to

We may disclose personal information to:

  • Transport and delivery providers, so that your order can be delivered to the right place;
  • Suppliers and manufacturers, where necessary to fulfil a special order, resolve a product issue or conduct a product withdrawal;
  • Professional advisers such as our accountants, auditors and lawyers, under obligations of confidentiality;
  • Service providers who host our systems, provide email services or process payments on our behalf;
  • Credit reporting or debt recovery providers, where an account is in default; and
  • Government agencies, regulators and courts, where disclosure is required or authorised by law.

We do not sell personal information, and we do not disclose it to third parties for their own marketing purposes.

Overseas disclosure

Because we source products internationally and use common business software, some information may be stored or accessed outside Australia by our service providers or overseas suppliers. Before disclosing personal information to an overseas recipient we take reasonable steps, as required by APP 8, to ensure the recipient does not breach the Australian Privacy Principles in relation to that information.

7. Cookies and this website

This website is a static site. It does not use advertising cookies, analytics cookies, tracking pixels or third-party scripts, and it does not build a profile of you.

Our hosting provider keeps standard server logs, which may record your IP address, the pages requested, the date and time of the request and your browser type. These logs are used to keep the site available and secure, and to diagnose faults. Your browser may also store a small number of strictly necessary items required to serve the page.

The enquiry form on our contact page opens a message in your own email application; it does not transmit your details to any third-party form service.

8. Storage, security and data quality

We take reasonable steps to protect personal information from misuse, interference and loss, and from unauthorised access, modification or disclosure. Those steps include restricting access to records to people who need it for their role, using access controls and passwords on our systems, and requiring confidentiality from our service providers.

No method of transmission or storage is completely secure. If you send us information by email, you do so knowing that email is not a secure medium.

We also take reasonable steps to ensure the personal information we collect, use and disclose is accurate, up to date, complete and relevant. Please tell us if your details change.

9. How long we keep it

We keep personal information only for as long as it is needed for the purposes described in this policy, or for as long as we are required to keep it by law. Business and taxation records are generally retained for at least seven years. Food traceability records are retained for the period appropriate to the shelf life of the product and our obligations under food law. When information is no longer needed and we are not required to retain it, we take reasonable steps to destroy it or to de-identify it, as required by APP 11.2.

10. Access and correction

You may ask us for access to the personal information we hold about you, and you may ask us to correct it if you believe it is inaccurate, out of date, incomplete, irrelevant or misleading. Write to [email protected].

We will respond within a reasonable period, usually within 30 days. We may ask you to verify your identity before we release information. We do not charge for making a request; if the request requires substantial work we may charge a reasonable cost-based fee for giving access, and we will tell you before we do. If we refuse access or correction, we will give you written reasons and tell you how to complain.

11. Notifiable data breaches

If we suffer a data breach that is likely to result in serious harm to an individual whose personal information we hold, we will comply with the Notifiable Data Breaches scheme in Part IIIC of the Privacy Act — we will contain and assess the breach, notify affected individuals, and notify the Office of the Australian Information Commissioner.

12. Complaints

If you believe we have breached the Australian Privacy Principles or otherwise mishandled your personal information, please tell us first. Email [email protected] with the words “Privacy complaint” in the subject line, and set out what happened and what you would like us to do.

We will acknowledge your complaint, investigate it and respond in writing, normally within 30 days. If you are not satisfied with our response, you may complain to the Office of the Australian Information Commissioner (OAIC), which is the independent regulator of privacy in Australia. Contact details for the OAIC are published on the Commissioner's website, and complaints may be made online, by post or by telephone.

13. Changes to this policy

We may update this policy from time to time to reflect changes to our practices or to the law. The current version is always the one published on this page, and the date at the top shows when it last changed. Material changes affecting existing customers will be notified with their next order confirmation.
